Amendments to the Cherrywood SDZ Planning Scheme
Dún Laoghaire-Rathdown County Council, in its role as Planning Authority, has made seven applications to An Bord Pleanála to amend the Cherrywood SDZ Planning Scheme 2014 (as approved) a summary of which is set out below:
Amendments 1 - 4 - Decision issued by An Bord Pleanála to Dún Laoghaire-Rathdown County Council in June 2017 under Section 170(A) of the Planning and Development Act 2000 (as amended). These amendments arose from the introduction in December 2015 of the "Sustainable Urban Housing: Design Standards for New Apartments Guidelines for Planning Authorities". The application of the policy standards in these Guidelines resulted in inconsistencies within the approved Planning Scheme which required clarification and amendment. A proposed amendment was included in the submission for Amendments 1 - 4 and related to retail sequencing, which was subsequently withdrawn from the statutory process. Amendment 5 was made in July 2018 to amend the Planning Scheme in relation to Chapter 7: Sequencing and Phasing of Development. The purpose of the Amendment is to accelerate the delivery of housing acknowledging the large scale of infrastructure of roads and public parks delivered to date in opening up lands for development . Amendment 6 was made in October 2019 to amend the Scheme in relation to Residential Car Parking Standards (Section 4.2.10 of the Approved Planning Scheme 2018). The purpose of the proposed amendment is to update the Cherrywood SDZ Planning Scheme so as to align with Government Policy on housing and in particular to take cognisance of the updated ministerial guidance on car parking provision for apartment development as set out in the “Sustainable Urban Housing: Design Standards for New Apartments, Guidelines for Planning Authorities (March 2018)” as published by the Department of the Housing Planning and Local Government (DHPLG). Amendment 7 was lodged in October 2020 and relates to the realignment of Beckett Road from its intersection with Lehaunstown Lane to its intersection with Cherrywood Avenue at Junction H and Ancilliary Amendments. Amendment 8 was considered at a Special Meeting of the County Council on 25th April 2023, at which it was agreed by resolution to make the proposed Amendment, as per Section 169 (4)(b)(i) of the Planning & Development Act 2000 (as amended) subject to all (nine) of the variations or modifications, to the Cherrywood SDZ Planning Scheme 2014 (as amended). Subject to an appeal being received within 4 weeks of this decision and by 23rd May 2023, the Amendment No. 8 would come into effect as of that date.
One valid appeal was lodged by the required date, however, was subsequently withdrawn on 6th July 2023. Noting no other appeal was received, Approved Amendment No. 8 in respect of the Building Height and Density Review is now in effect as and from 6th July 2023. The Cherrywood Planning Scheme 2014 document, (as amended in 2018), will be updated to incorporate the approved amendment once the appeal period has ended. A revised document will be made available in due course both on the web and in hard copy format. However, in the interim, the Scheme must be read in conjunction with the Final Text documents, which can be accessed through the links above or via the Related Documents link.
Proposed Amendment 9 An Bord Pleanála, as the competent authority, notified the Planning Authority on 17 May 2024 regarding their determination, under Section 170A(4)(b), that the proposed Amendment to the Cherrywood Planning Scheme constitutes a material change but which falls within the criteria set out in subsection 3(b).
Following the statutory public consultation period, which took place between 31st May 2024 - 1st July 2024, (Please see link to statutory public consultation: here) the Planning Authority’s Response on Submissions Received was submitted to An Bord Pleanála on 25th July 2024, for their further determination.
