All developments require planning permission unless it is an exempted development.

Categories of exempted developments are listed in the Planning and Development Regulations, 2001 as amended



Section 5: Referral or Exemption Declaration

The purpose of a Section 5 of the Planning and Development Act 2000, as amended, is to establish if a particular development is or is not an exempted development within the meaning of the Act. 

If you are not sure if your development is exempt of not. You can apply for a document called a declaration of exemption which will confirm whether or not you require planning permission.

In accordance with the Planning and Development Act 2000, as amended any person may request a declaration from the Planning Authority as to whether a development is exempted from requirement for planning permssion or not.

To request a declaration for a Section 5 exemption, submit the following:
Application form
Location Map (scale 1:1000 in urban area), with the site clearly outlined in red. 
Full details and description of the proposed development.
Scale drawings and elevations.
Fee of €80.00

If detailed information/drawings are not provided, we may not be in a position to make a decision.


The Planning Authority is required to make a decision within 4 weeks of receipt of a Declaration Request under Section 5, along with the prescribed fee of €80 Euro, however the Planning Authority can also request Additional Information if it is considered that insufficient information has been submitted.
