Any member of the public has the right to make a submission or observations to a planning application, under Article 29 of the Planning and Development Regulations 2001 (as amended).

 
Anyone making written comment on an application is informed of the Council's decision and of the right to appeal to An Bord Pleanála against the Council's decision.
 
Submissions/observations must be accompanied by a fee of €20.00.

Please note that anyone other than the applicant can make a submission on a planning application.

Make an Online Submission

 
 

The Planning Authority currently operates an online portal that allows contributors to process the payment and submit their observation, as per Article 29 (4) of the Planning and Development Regulations 2001 as amended, for a planning application . The Planning Authority were until recently sending each contributor a hard copy letter confirming their submission had been accepted.

From now on the Planning Authority are responding to any individual or entity who submits their observation through the online portal with a soft copy of the confirmation via email.
The Planning Authority will continue to respond to any individual or entity in hard copy format who submits an observation in hardcopy format.

The contributor who has made a valid submission can then use this soft copy to satisfy the requirements of Section 127(1)(e) of the Planning and Development Act, as amended (link embedded and extract below) if or when they choose to appeal the planning decision in question.

“(e) in the case of an appeal under section 37 by a person who made submissions or observations in accordance with the permission regulations, be accompanied by the acknowledgement by the planning authority of receipt of the submissions or observations,”

 

Please note the following.

Please be aware that submissions/observations for Strategic Housing Development SHD applications must be sent to An Bord Pleanála only.  Any submissions on SHD applications which are sent to this County Council will be returned to the sender.

Please be aware that submissions/observations from third parties in relation to Significant Further Information must be submitted by post or email (planning@dlrcoco.ie) and cannot be submitted via the online submission portal.

•Submissions/observations must be made within 5 weeks beginning on the date of receipt of the planning application. The five week period commences on the day that a planning application is received, such that the last day for receipt for a submission/observation to an application received on Tuesday 1 November is Monday 5 December. If the last day of this five week period falls on a Saturday, Sunday or Public Holiday, submissions/observations can be accepted on the next working day.
 
•Submissions/observations received after the period of 5 weeks beginning on the date of receipt of the application shall be returned to the person concerned along with the fee and cannot be considered by the planning authority.
 
•Submissions/observations must be accompanied by a fee of €20.00 which can be payable by cheque / postal order / laser / credit card.
 
•Cheques and Postal Orders should be made payable to Dun Laoghaire Rathdown County Council
 
•No cash to be included in postal submission/observation.
 
•If no fee is attached to the submission/observation it will not be considered and shall be returned as invalid.
 
•Any submission/observation received shall state the name of the person or body making the submission/observation, indicate the address to which any correspondence relating to the application may be sent and include the reference number of the application concerned.
 
•In the case of a submission/observation with multiple signatories, an acknowledgement will be sent to one signatory only, the address of which should be indicated on the submission/observation.
 
•Please note, in accordance with Article 35 of the Planning and Development Regulations, persons who made a submission or observation on a planning application will only be notified of the receipt of Further Information or Clarification of Further Information,where that Further Information or Clarification of Further Information is considered significant and requires new public notices.  Further Submissions from existing submitters can only be accepted following the receipt of significant Further Information.  There is no legal provision to accept submissions / observations when Further Information is not significant.
 
Withdrawal of an submission/observation:
There is no mechanism in the regulations for the withdrawal of submissions or observations.  You may however, make a further addition to your submission instructing the Planning Authority to disregard your original observation.  This must be done as soon as possible, as we can only accept any form of submission on a planning application within the first five weeks.  Both letters then remain on the file.
 

Defamation:

Persons making a submission/observation on a planning application should be aware that comments involving allegations of any kind against a named or otherwise identifiable person or organisation may be viewed as defamatory by the subject of the comments. Persons may be sued directly for any defamatory allegations in any submission/observation and should avoid making such allegations. Any submission/observation made to the Planning Authority is made available for public inspection both in the hard copy file and on the Council's website. In the event of any potentially defamatory allegation giving rise to legal action against it, the Planning Authority may seek indemnity from the person making the allegation.
 

Data Protection:

The planning process is an open and public one.  In that context, all planning application documents are made available for public inspection.  This information may also be placed on the Council's website.

In accordance with Article 35 of the Planning and Development Regulations, persons who made a submission or observation on a planning application will only be notified of the receipt of Additional Information or Clarification of Additional Information, where that AI or CAI is considered significant and requires new public notices.  Objectors have 2 weeks ( 5 weeks in case of applications accompanied by an EIS) from the date of receipt by the Planning Authority of the revised notices, to make further submissions/observations.  No further fee is required.  Other persons wishing to make a submission/observation will be required to pay the prescribed fee.

Yes, subject to: 

  • Not more than 2m high to the rear.
  • Not more than 1.2 metres to the front or forward of the front of the house.

    (Page 157, Class 5).

    NB: Metal palisade or other security fencing is not exempt.

 

Yes provided that:

  • It is not forward of the front wall of the house;
  • Not greater than 25sqm total area (not floor area) (or no. of sheds aggregated);
  • 25sqm of garden space is left. N.B. extensions attached to house are not reckoned as private open space;
  • Shed finish is in keeping with the house;
  • Shed height: max 4m pitched roof; 3m flat roof;
  • It is not lived in or used for keeping of animals (pigs, ponies, horses, pigeons).

Yes, provided that:

  • Not less than 2 metres from roadway;
  • Not more than 2sqm Height: 3m max for a Flat Roof, 4m max Pitched Roof.

Yes, except for a mural and providing the house is not a Protected Structure.

No, not in the normal way, but, is subject to the consultation procedures contained in Part VIII of the 2001 Planning Regulations as amended.

Planning permission has no impact on the need for a Disability Access Certificate. If the works began on a building (other than dwellings houses) on or after January 1st 2010, then the Disability Access Certificate is required.
